Terms and Conditions

§ 1 Scope, Provider

(1) These General Terms and Conditions (hereinafter “GTC”) apply to all orders placed by consumers and businesses through our online store at festival-faecher.de with the

(2) For the purposes of these Terms and Conditions, a “consumer” is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity (Section 13 of the German Civil Code (BGB)). An entrepreneur is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of its commercial or self-employed professional activity (Section 14 of the German Civil Code (BGB)).

(3) The version of the Terms and Conditions in effect at the time of the order shall apply. We do not recognize any deviating terms and conditions of the customer unless we have expressly agreed to their validity in writing.

§ 2 Conclusion of the Contract

(1) The presentation of products in the online store does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

(2) By clicking the order button (“Place order” or similar), you are submitting a binding offer to purchase the items in your shopping cart. Immediately after submitting the order, you will receive a confirmation of receipt of your order (order confirmation). This order confirmation does not yet constitute acceptance of your offer.

(3) The contract is concluded when we accept your offer by issuing an order confirmation or by shipping the goods. If neither acceptance nor shipment occurs within five days, the offer is deemed to have been rejected.

(4) We will save the contract text and send it to you via email along with the Terms and Conditions. You can also view your order details in your customer account, provided you have created one.

(5) The language of the contract is German.

§ 3 Prices and Shipping Costs

(1) All prices listed are final prices and include the applicable sales tax.

§ 4 Payment

(1) Payment can be made via PayPal, credit card, SEPA direct debit, Apple Pay, or Google Pay. Credit card, SEPA, Apple Pay, and Google Pay transactions are processed by our payment service provider, Stripe; PayPal payments are processed by PayPal.

(2) The payment methods available in each specific case will be displayed during the ordering process.

(3) The purchase price is due upon conclusion of the contract.

(4) If you are in default of payment, we are entitled to charge interest on late payments at the statutory rate. We reserve the right to claim further damages.

§ 5 Delivery

(1) Delivery is available within Germany and to the countries listed on the website Versand & Zahlung the EU countries listed above.

(2) Information on delivery times can be found on the product page and on the Shipping & Payment page. Unless otherwise stated, these are estimated delivery times.

(3) If an ordered product is unavailable, we will notify you immediately. In such cases, we will promptly refund any payments already made.

§ 6 Retention of Title

The delivered goods remain our property until full payment has been received.

§ 7 Right of Withdrawal

Consumers have a statutory right of withdrawal. The details are set forth in our Widerrufsbelehrung.

§ 8 Warranty / Liability for Defects

(1) The statutory provisions regarding liability for defects apply.

(2) An additional warranty applies to the goods we deliver only if it was expressly stated in the order confirmation for the respective item.

(3) Please note that minor variations in color, material, or workmanship compared to the product image may occur due to the manufacturing process. Such variations do not constitute a defect.

§ 9 Liability

(1) We shall be liable without limitation for damages resulting from injury to life, limb, or health caused by a negligent or intentional breach of duty on our part or on the part of our legal representatives or agents.

(2) We shall be liable without limitation for other damages only to the extent that such damages result from willful misconduct or gross negligence. We are also liable for breaches of material contractual obligations (cardinal obligations) in cases of simple negligence, but the amount of liability is limited to the foreseeable damage typical for this type of contract. Essential contractual obligations are those whose fulfillment is essential for the proper performance of the contract and on whose compliance the customer may regularly rely.

(3) Any further liability is excluded, regardless of the legal nature of the claim asserted. Liability under the Product Liability Act remains unaffected.

§ 10 Product Safety

§ 11 Dispute Resolution

(2) We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 12 Final Provisions

(1) The laws of the Federal Republic of Germany shall apply, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods. With respect to consumers, this choice of law shall apply only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has his or her habitual residence.

(2) Should any provision of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions.
